1. Definitions

In these Terms:

• – “Bluntly AI”, “we”, “us”, “our”: Refers to Bluntly, the company operating the platform.
• – “Services”: Refers to the AI-powered analysis and feedback services provided by Bluntly AI, including academic, career, and business document evaluation, as well as enterprise solutions for institutions.
• – “Uploaded Content”: Refers to any documents, assignments, CVs, job descriptions, or materials uploaded or typed in by the user for analysis.
• – “Credits”: Refers to units of service usage. A free trial includes 14 credits.
• – “Subscription Plans”: “Subscription Plans”: Refers to the paid plans Basic ($5/month), Lite ($10/month), Pro ($15.99/month), and Enterprise Plans for institutions.
• – “Enterprise Plan”: Refers to a custom-designed subscription tailored for institutions, such as universities, corporations, or other large entities, governed by specific terms agreed upon in a separate contract.

2. Eligibility

• 1. Minimum Age Requirement:
  You must be at least 16 years old to use our services.
• 2. Parental Consent:
  Users under 18 must have explicit consent from a parent or guardian.
• 3. Compliance with Laws:
  You are responsible for ensuring your use of Bluntly AI complies with applicable laws in your jurisdiction.
• 4. Prohibited Access:
  • - The platform is not available to individuals or entities previously banned from using our services.
  • - Users engaging in fraudulent activity, including misrepresentation, are prohibited from accessing the platform.

3. Services Provided

• 1. Nature of Services:Bluntly AI provides AI-powered feedback for academic assignments, CVs, job applications, business analyses, and enterprise solutions for institutions.
• 2. Advisory Nature:

  - Feedback is educational and advisory in nature. It is not a guarantee of academic grades, job placements, or successful business outcomes.

  - Users should independently validate feedback and consult professionals as needed.

• 3. Content Suitability:Users are responsible for ensuring uploaded content complies with copyright laws and is lawful and appropriate for analysis.
• 4. Modification of Services:We reserve the right to modify, suspend, or terminate any part of the services without prior notice.

4. Enterprise Plans

• 1. Custom Agreements: Institutions or enterprises subscribing to the Enterprise Plan will enter into a separate agreement outlining specific terms, pricing, usage limits, and data privacy requirements. These terms are supplementary to the general Terms and Conditions herein.
• 2. Institutional Responsibility: Institutions must ensure that their authorized users comply with these Terms. Any breach by individual users may result in action against the institution, including suspension of services.
• 3. Non-Refundable Payments: Payments for Enterprise Plans are non-refundable once the agreement is executed, except in cases of billing errors or service interruptions exceeding 30 consecutive days.
• 4. Data Privacy: Institutions must disclose to their users how their data will be processed through Bluntly AI. All uploaded data is subject to automatic deletion from user dashboards within 24 hours unless otherwise agreed in writing.
• 5. Limitations of Use: Enterprise Plan licenses are limited to the agreed number of users or uploaded content volumes. Exceeding these limits without prior written consent will result in additional charges.

5. Free Trials and Promotions

• 1. Free Trials:
  • ○ New users are entitled to a free trial with 14 credits.
  • ○ Credits must be used within 30 days of activation. Unused credits will not roll over.
  • ○ Free trials are limited to one per user, household, or IP address.
• 2. Promotions:
  • ○ Promotional offers are subject to specific terms communicated during the offer period.
  • ○ Promotions cannot be combined with other discounts unless explicitly stated.
• 3. Misuse Consequences:
  • ○ Abuse of free trials or promotions will result in immediate termination of the account and forfeiture of unused credits.

6. Subscriptions and Payments

• 1. Subscription Plans:
  • ○ Basic: $5/month for core services with limited features.
  • ○ Lite: $10/month for enhanced analysis and recommendations.
  • ○ Pro: $15.99/month for full access, priority processing, and advanced insights.
  • ○ Enterprise Plan: Custom pricing and terms based on institutional needs, as agreed upon in a separate contract.
• 2. Payment Processing:
  • ○ Payments are securely processed through third-party providers (e.g., Stripe, PayPal).
  • ○ Bluntly AI does not store payment details.
• 3. Chargebacks:
  • ○ Chargebacks are not permitted for any reason. Users agree to resolve any payment disputes directly with Bluntly AI before initiating a claim with their bank.
  • ○ Unauthorized chargebacks will result in account suspension and additional administrative fees.
• 4. Renewals and Cancellations:
  • ○ Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
  • ○ Users are responsible for managing cancellations via their account dashboard.
• 5. Refund Policy (According to UK Laws):
  • ○ Automatic Renewals: If a subscription renews automatically, you are entitled to a refund within 14 days, provided no credits have been used.
  • ○ After 14 Days: Refunds are not eligible beyond 14 days of automatic renewal.
  • ○ Failed Payments: If payment fails, refunds are the responsibility of your bank. Contact your bank directly for further assistance.
  • ○ Refunds for billing errors or technical interruptions will be reviewed on a case-by-case basis.
• 6. Refill Options:
  Users may purchase additional credits starting at $1 per unit.

7. Uploaded Content

• 1. Temporary Retention:
  Files uploaded or typed into the platform are not stored permanently.
  • ○ Output files are automatically deleted from our servers immediately after processing.
  • ○ Users can delete uploaded content or threads immediately from their dashboard, or they will be automatically deleted within 24 hours.
• 2. User Responsibility:
  Users are encouraged to download or save their feedback before it is deleted.

8. Intellectual Property

• 1. Bluntly AI Ownership:
  All intellectual property related to the platform—including its design, structure, and proprietary user interface—is owned by Bluntly.
  • ○ The AI models integrated into the platform are licensed to Bluntly AI under full compliance with applicable regulations.
  • ○ Algorithms and workflows specific to user feedback generation and analysis were developed and customized by Bluntly.
• 2. License to Use Feedback:
  Users receive a limited, non-transferable license to use feedback generated solely for personal or institutional purposes.
• 3. Prohibited Redistribution:
  Users may not resell, share, or redistribute AI-generated feedback without explicit permission from Bluntly AI.

9. Indemnification

You agree to indemnify and hold harmless Bluntly AI, its officers, employees, and affiliates from any claims, damages, or liabilities arising from:

10. Governing Law and Dispute Resolution

• 1. Applicable Law: These Terms are governed by the laws of England and Wales.
• 2. Dispute Resolution: Disputes shall be resolved exclusively in the courts of England and Wales.

11. Miscellaneous

• 1. Entire Agreement: These Terms, together with the Privacy Statement, constitute the entire agreement between you and Bluntly AI.
• 2. Severability: If any provision is deemed invalid, the remaining provisions will remain enforceable.
• 3. No Waiver: Failure to enforce a provision does not waive our right to enforce it later.
